Medical Records — HIPAA & Texas Medical Privacy Act

How to Request Clinical Records

Clients have the right to access their clinical records in accordance with HIPAA, the Texas Medical Privacy Act, and 42 CFR Part 2. Requests must be made using the Texas Standard Authorization Form (HB 300) per Texas Health & Safety Code §181.154(d).

This form requires separate initials to authorize release of Mental Health Records and Drug, Alcohol, or Substance Abuse Records. Both sets of initials are required for dual-record requests.

Please submit the completed signed form via your SimplePractice Client Portal. Processing time: up to 15 business days as permitted by Texas law. A reasonable, cost-based fee may apply.

42 CFR Part 2 — Federal Heightened Confidentiality

Substance Use Disorder Records

All records related to chemical dependency services are maintained with heightened confidentiality under Federal law (42 CFR Part 2) — stricter than HIPAA.

Substance use disorder records cannot be released without specific written consent that explicitly references 42 CFR Part 2 protections, except as specifically permitted by law.

This applies to all records created in connection with LCDC-Intern services provided by Stacy Reynolds, LCDC-Intern #72791, under the supervision of Lisa Powell, Ph.D., LMFT-S.
